What Are the Arizona DUI Laws?
Arizona DUI laws are some of the toughest in the nation. However, the Arizona Revised Statutes do differentiate between different kinds of DUIs: standard, extreme, and aggravated. The type of DUI you’re charged with determines whether you’re convicted of a misdemeanor or felony:
- DUI. In Arizona, you’re charged with a DUI when you’re caught operating a vehicle with a blood alcohol concentration of 0.08% (or higher) or any amount of illegal drug in your system.
- Extreme DUI. People are charged with extreme DUIs when caught operating a vehicle with a blood alcohol concentration of 0.15% or more.
Aggravated DUI. You can be charged with an aggravated DUI if you’re caught operating a vehicle while your license is revoked or suspended; if you’ve been previously convicted of two or more DUIs in the last seven years; if there’s a passenger under 15 in the vehicle with you; or if you’re driving on the wrong side of the highway.
What Happens After a First-Time DUI?
After being convicted of a first-time DUI in Arizona, you are sentenced to ten consecutive days in jail (without probation), up to $2,500 in fines, community service, and successfully completing a traffic survival course. Suppose your DUI conviction was from alcohol intoxication (instead of drugs). In that case, you’re required to install a certified ignition interlock device in any vehicle that you operate for the next year (at least).
Can I Refuse a Blood or Breath Test?
Arizona law maintains an implied consent provision. Essentially, this assumes that all motorists consent to a chemical test when stopped for a suspected DUI. If you refuse to take either of the chemical tests, your license could be suspended for a year. And if you refuse a chemical test for the second time within seven years, your license is suspended for at least two years.
